A current claim to be heard by the Pennsylvania Supreme Court is stirring debate over whether a public entity can recover its recent expenses to repair an alleged omission in 40-year-old construction from the successor firms to the original architect/engineer and builders. Attorney Michael Pascoe, who has been involved in providing an amicus brief to the court, will introduce us to the case, the theory on which the plaintiff is basing its claim, and the legal framework on which the lower courts have relied thus far to deny the claim.

Panelists will briefly discuss design and construction quality assurance procedures typically followed to limit errors and omissions, how standards of care may have been different in the early 1980’s, record documents that should be retained, potential ramifications for other projects, the need for closure, and how physical damages or personal injuries resulting from an error or omission might affect liability term limits. Jon O’Brien will also outline efforts being made in Pennsylvania to legislate clearly defined time limits on A/E/C liability for public and private projects. Input and questions from attendees will be welcome!

Learning objectives:

  • Recognize the obligation of building owners to provide facilities that are conducive to the safety and well-being of their occupants.
  • Identify traditional contract and statutory provisions governing post-construction error and omission claims.
  • Understand QAQC procedures that limit or eliminate post-construction error and omission claims and help to ensure life safety.
  • Ascertain the construction project record documents necessary for long term retention and how they may help in future claims resulting from personal injury, physical damage, or the cost of remedying design or construction errors or omissions.

This program has been submitted to the AIA CES for 1 HSW/LU. Continuing education certificates will be available to all attendees.

Dinner reservations are required for all attending at $30 per person.
